NJ Office of Administrative Law upholds 2017 Hambletonian disqualification

Columbus, OH — On Tuesday (Dec. 11), The State of New Jersey Office of Administrative Law upheld the decision of the New Jersey Racing Commission and “ordered that (driver) David Miller be suspended for three days” and “further ordered that the disqualification of ‘What The Hill’ is upheld and that the portion of the Hambletonian purse of 2017 be distributed in accordance with this decision.”

In the decision, the NJ OAL further stated, “This recommended decision may be adopted, modified or rejected by the NEW JERSEY RACING COMMISSION, which by law is authorized to make a final decision in this matter.”

If the NJ Racing Commission does not act upon the decision within 45 days and the time limit is not otherwise extended, the decision becomes final.

In addition to the ruling in David Miller v NEW JERSEY RACING COMMISSION, this decision also addresses the Burke Racing Stable, LLC ET AL v NEW JERSEY RACING COMMISSION petition due to the fact that the two cases were consolidated on Nov. 29, 2017.
