NY appeals court rules in favor of off-track drug testing

Columbus, OH — According to a story on courthousenews.com, an appeals court has ruled that the state of New York can once again perform off-track drug tests of harness horses.

The New York State Racing and Wagering Board adopted the “out-of-competition” testing rules in late 2009, but horsemen challenged the new rules in early 2010, arguing they were unconstitutional and that the Racing and Wagering Board had overstepped its bounds. Acting Justice Mark Powers of the Schenectady County Supreme Court agreed in August 2011.

This past Thursday (June 6), the Appellate Division reversed the August 2011 ruling.
