USTA applauds ruling finding HISA unconstitutional for a third time; Fifth Circuit rules HISA violates the nondelegation doctrine
The United States Trotting Association (USTA) applauded Thursday’s (June 11) unanimous ruling by the United States Court of Appeals for the Fifth Circuit, finding the Horseracing Integrity and Safety Act (HISA) unconstitutional for a third time. The court ruled, “HISA violates the nondelegation doctrine” by unlawfully giving governmental power to a private corporation.

“In a ruling issued Thursday (June 11), The United States Court of Appeals for the Fifth Circuit has ruled that the enforcement provisions for the Horse Racing Integrity and Safety Act violate the private non-delegation doctrine in the United States Constitution,” according to Thoroughbred Daily News.”

The Virginia Harness Horse Association (VHHA) announced that a record $500,000 in bonus monies will be available annually to standardbred foals that participate in its lucrative Certified Residency Program beginning with the 2026 foal crop and beyond. The current $400,000 bonus level still applies to the 2025 foal crop, whose owners have less than a month to get their horses registered in the program.
